USCIS describes the assessment as prospective, meaning the officer considers whether the applicant is likely at any time to become a public charge.

Importantly, USCIS states that no single factor, other than an insufficient Form I-864 where one is required, is automatically outcome-determinative.

This means an applicant’s circumstances have to be considered together rather than assessed through one isolated factor.

Public benefits can now form part of the overall assessment

Another important aspect of the revised framework concerns means-tested public benefits.

USCIS may consider an applicant’s current or past receipt of means-tested public benefits, as well as certain applications, approvals or certifications for such benefits, when conducting the overall public charge assessment.

However, receiving a benefit does not automatically mean that an applicant will be found inadmissible.

The guidance directs officers to consider factors such as:

The type or nature of the benefit

The amount received

How recently it was received

How long the applicant received it

The circumstances surrounding the benefit

Whether those circumstances are likely to continue

The applicant’s other financial and personal circumstances

USCIS also makes clear that past or current receipt of benefits, by itself, is not enough to establish that someone is likely to become a public charge. Conversely, an applicant does not necessarily avoid a public-charge finding simply because they have never received public benefits.

What happens to Form I-485 applications?

The effective date is particularly important for people preparing an Adjustment of Status application.

The new framework applies to relevant Form I-485 applications postmarked or electronically submitted on or after 18 September 2026. Applications submitted before that date continue to be handled under the framework applicable when they were filed.

USCIS has also introduced a new edition of Form I-485 aligned with the revised public charge framework. Applicants should therefore check the form edition and filing instructions applicable on the date they submit their application rather than relying on an older version.

For applicants preparing a filing now, this makes it important to review the entire application package before submission, particularly financial evidence and any documents relevant to the public charge assessment.

Why financial documentation matters more

The broader assessment means that applicants should pay close attention to how their overall financial circumstances are presented.

Depending on the case, relevant evidence may include information relating to:

Household income and financial resources

Assets and liabilities

Education and professional skills

Family circumstances

Health-related circumstances relevant under the applicable rules

The required Form I-864 and supporting evidence

Relevant public-benefit history

The purpose is not simply to show that an applicant has money in the bank. USCIS assesses the overall circumstances and whether those circumstances indicate a likelihood of becoming a public charge.

Adjustment of Status and immigrant visa processing are different

It is also important to distinguish between applicants applying for a Green Card inside the United States through Adjustment of Status and applicants completing the immigrant visa process through a U.S. embassy or consulate abroad.

For Adjustment of Status cases, USCIS conducts the relevant public-charge assessment as part of the I-485 adjudication.

For applicants processing an immigrant visa outside the United States, the case is handled through the Department of State’s consular process.

This distinction is particularly relevant for applicants in India because immigrant visa interview scheduling is handled through the National Visa Center and the relevant U.S. consular post.

India applicants should check the relevant U.S. post

The Department of State’s Immigrant Visa Scheduling Status Tool provides post-specific information showing the documentarily complete cases for which the National Visa Center is currently scheduling interviews. The information is updated monthly.

The current tool lists both New Delhi and Mumbai among the immigrant visa processing posts and provides separate scheduling information by visa category.

This means applicants should avoid relying on broad statements about a worldwide immigrant visa interview suspension or delay.

Instead, they should check:

Their immigrant visa category

Their documentarily complete date

The assigned U.S. embassy or consulate

The latest Department of State scheduling information

Their CEAC case status and NVC communications

The Department of State also notes that the scheduling tool does not guarantee a specific appointment date because several factors can affect interview scheduling.

What should Green Card applicants do now?

Anyone preparing a relevant Adjustment of Status application should review the filing carefully under the new framework before submission.

In particular, applicants should:

Confirm that they are subject to the public charge ground of inadmissibility.

Use the correct and current Form I-485 edition.

Review their financial circumstances and supporting evidence.

Prepare the Form I-864 correctly where required.

Consider whether relevant public-benefit history needs to be addressed.

Ensure that information across the application and supporting documents is consistent.

Check the latest USCIS filing instructions before submitting the application.

Applicants completing immigrant visa processing outside the United States should separately monitor their NVC case status, Visa Bulletin position where applicable, and the scheduling status of their assigned U.S. consular post.

The practical takeaway

The latest public charge changes do not create an automatic rule under which receiving a public benefit results in Green Card refusal.

Instead, the revised approach gives immigration officers a broader framework for considering an applicant’s circumstances as a whole. Age, health, family circumstances, financial resources, education and skills, the required Affidavit of Support and other relevant information can all form part of the assessment.

For applicants filing Form I-485 on or after 18 September 2026, the change makes careful preparation particularly important. Those applying through consular processing should likewise rely on the Department of State’s post-specific information rather than general claims about visa scheduling.

Applicants seeking a U.S. Green Card through Adjustment of Status now face a broader public charge assessment following a major change in the way the United States evaluates certain immigration applications.
