Ministerial Directions 121 and 122 came into effect on 19 September 2026, replacing the processing priorities previously established under Ministerial Direction 119.

The change affects how the Department of Home Affairs decides which applications should be considered first. It does not change the basic eligibility requirements, occupation lists or visa criteria that applicants must satisfy.

For skilled applicants and sponsoring employers, the new framework makes the nominated occupation, visa subclass, applicant’s location and application composition important factors in understanding processing priority.

Two Ministerial Directions now govern skilled visa processing

The new framework separates temporary skilled visa applications from certain provisional and permanent skilled visa applications.

Ministerial Direction

Main area covered

Direction 121

Certain temporary skilled visas, including the Skills in Demand visa subclass 482

Direction 122

Certain provisional and permanent skilled visas, including subclasses 186, 189, 190, 191, 491 and 494

The Department of Home Affairs confirms that both directions commenced on 19 September 2026 and replaced the processing priorities previously operating under Direction 119.

Which sectors receive the highest priority?

Under both new directions, the highest processing priority is given to eligible applications connected with specified sectors and national interests.

These include:

Construction

Healthcare

Teaching

Agriculture

Aquaculture

Fishing

Resources

Australian law enforcement interests

Australian defence interests

However, applicants should understand that the priority framework generally refers to specified occupations and eligible positions, rather than automatically covering every job within a broad industry.

The relevant occupation, nominated position and applicable requirements must therefore be examined before determining whether an application falls within the highest-priority group.

How does Direction 121 affect subclass 482 applications?

Ministerial Direction 121 primarily governs applications for the Skills in Demand visa, subclass 482.

The processing order under Direction 121 is broadly structured as follows:

First priority: Specified sectors and national interests

Applications connected with the listed priority sectors, or with Australia’s law enforcement and defence interests, are considered first.

Second priority: Specialist Skills stream

Applications under the Specialist Skills stream of the Skills in Demand visa have a separate priority group.

This stream is placed after the specified priority-sector group and before the remaining categories based on the applicant’s location.

Third priority: Applicants already in Australia

Applications where the primary applicant was in Australia when the visa application was lodged are considered after the first two groups.

Fourth priority: Certain offshore applicants

This group covers applications where:

The primary applicant was outside Australia when the application was lodged; and

The application is not combined with another person’s application at any time.

Fifth priority: Remaining applications

All other applications fall into the final processing group under Direction 121.

This means that the location of the applicant and whether the application is combined with another person’s application can affect the order in which a subclass 482 application is considered.

How does Direction 122 apply to permanent and provisional skilled visas?

Ministerial Direction 122 applies to certain provisional and permanent skilled visa applications.

The visa subclasses covered include:

Subclass 186 — Employer Nomination Scheme

Subclass 187 — Regional Sponsored Migration Scheme

Subclass 189 — Skilled Independent

Subclass 190 — Skilled Nominated

Subclass 191 — Permanent Residence (Skilled Regional)

Subclass 489 — Skilled Regional

Subclass 491 — Skilled Work Regional

Subclass 494 — Skilled Employer Sponsored Regional

Subclass 887 — Skilled Regional

Subclass 888 — Business Innovation and Investment (Permanent)

The Department’s published list includes both open and certain legacy visa categories where applications may still remain undecided.

The processing order under Direction 122 is generally:

Applications connected with the specified priority sectors or Australian law enforcement and defence interests.

Applications where the primary applicant was in Australia at the time of lodgement.

Applications where the primary applicant was outside Australia and the application was not combined with another person’s application.

All other applications.

Unlike Direction 121, Direction 122 does not create a separate Specialist Skills priority group for subclass 482 applicants because that visa stream is dealt with under Direction 121.

Do the new directions affect applications already lodged?

Yes. The new processing framework can also affect certain applications that were lodged before 19 September 2026 but had not been finally decided by that date.

Such applications may be reassessed and placed within the new priority structure rather than continuing under the earlier Direction 119 arrangements.

This is particularly relevant for applicants and employers who have already submitted a skilled visa application and are waiting for a decision. The change in priority order does not necessarily mean that an application will be refused or approved. It may, however, affect when the Department takes up the application for processing.

Does priority processing guarantee a faster visa decision?

No.

A priority category determines the order in which applications are considered. It does not guarantee:

A specific processing timeframe

Faster approval

Waiver of eligibility requirements

Waiver of health or character checks

Exemption from document requirements

Approval of an incomplete or unsupported application

Applicants must continue to satisfy the relevant provisions of the Migration Act, Migration Regulations and applicable visa criteria.

A visa application placed in a lower-priority group may still be approved if all requirements are met. Similarly, an application placed in a high-priority group can still face delays or refusal if the applicant does not satisfy the applicable requirements.

Why processing times may fluctuate

The Department has warned that processing timeframes may fluctuate while applications are transitioned to the new priority framework.

Some published processing estimates may temporarily move backwards as applications are reorganised according to the new order.

Applicants should therefore avoid treating a published processing estimate as a guaranteed decision date. Processing may also depend on:

Whether the application is complete

Whether additional information is requested

Health and character checks

The complexity of the case

The visa subclass

The applicant’s location

The nominated occupation

The number of applications in the relevant priority group

What does this mean for Indian skilled applicants?

Indian applicants considering Australian skilled migration should review their circumstances under the new framework before lodging an application.

The following points may be particularly relevant:

The nominated occupation matters

Applicants should confirm whether their occupation and nominated position fall within one of the specified priority sectors. A general connection with healthcare, construction, teaching or another listed industry may not be sufficient if the occupation does not meet the applicable requirements.

Visa subclass matters

The priority rules differ depending on whether the applicant is applying for:

Subclass 482

Subclass 186

Subclass 190

Subclass 191

Subclass 491

Subclass 494

Another covered visa subclass

Location at lodgement matters

For certain categories, the Department distinguishes between applicants who were in Australia and those who were outside Australia when the application was lodged.

Applicants should not assume that moving between Australia and another country after lodgement will automatically change their priority position.

Application composition matters

For certain offshore applications, whether the primary applicant’s application is combined with another person’s application may affect the applicable processing group.

Families and accompanying applicants should therefore review how their applications are structured before lodgement.

What should employers and applicants do now?

Applicants and sponsoring employers should consider the following steps:

Identify the relevant visa subclass.

Check whether the nominated occupation falls within a specified priority sector.

Confirm whether the applicant was in Australia or overseas when the application was lodged.

Review whether the application is combined with another person’s application.

Check whether the application was lodged before or after 19 September 2026.

Ensure that all required documents and information have been submitted.

Monitor requests for further information from the Department.

Review the latest Department of Home Affairs processing guidance.

Avoid relying on unofficial claims of guaranteed priority or guaranteed approval.

Employers should also account for possible changes in onboarding timelines if a sponsored worker’s application is moved into a different processing group.

The key takeaway

Ministerial Directions 121 and 122 have changed the way Australia prioritises certain skilled visa applications.

The new framework gives priority to eligible applications connected with construction, healthcare, teaching, agriculture, aquaculture, fishing, resources, and Australian law enforcement or defence interests. Direction 121 also creates a separate priority group for the Specialist Skills stream of the subclass 482 visa.

For other applications, the applicant’s location and the structure of the application may influence processing order.

The most important point is that processing priority is not the same as visa eligibility. Applicants must still meet all legal and documentary requirements, and the Department may take additional time where an application requires further assessment.

Australia has introduced a new framework for prioritising certain skilled visa applications.
